Search engine rankings are determined by complex, proprietary algorithms maintained by Google, Bing, and other search engines. These algorithms consider hundreds of factors, many of which are outside the scope of any single audit tool and are subject to frequent, unannounced changes.

Implementing recommendations from SEO Agent may improve technical SEO quality, but:

• Results vary significantly by industry, competition, domain age, existing authority, and content quality
• Ranking improvements are never guaranteed and may take weeks or months to materialise
• Algorithm updates by search engines can reduce rankings independently of your site quality
• SEO Agent has no affiliation with, and receives no guidance from, Google, Bing, or any other search engine

Audit scores, grades, and metrics produced by SEO Agent represent our proprietary assessment methodology and do not reflect official evaluations by any search engine.

SEO Agent uses large language model AI (powered by Anthropic Claude) to generate:

• SEO fix recommendations and implementation guides
• Content optimisation suggestions (meta titles, descriptions, headings)
• Schema markup code
• AEO, GEO, and LLM SEO analysis findings
• Competitor gap summaries
• Content gap analyses and keyword recommendations

AI-generated content has the following known limitations:

• Hallucination: AI models may generate plausible-sounding but factually incorrect information
• Outdated knowledge: AI training data has a knowledge cutoff date and may not reflect current search engine guidelines
• Context blindness: AI cannot fully understand your business, brand voice, legal constraints, or competitive context
• Bias: AI outputs may inadvertently reflect biases present in training data
• Variability: The same query may produce different outputs on different occasions

You are solely responsible for reviewing, verifying, and editing any AI-generated content before publishing or implementing it. PiTech Studio is not liable for any consequences arising from your reliance on unreviewed AI outputs.

3.1 Legal status: Auditing publicly accessible third-party websites using standard HTTP requests is generally considered lawful under the legal principles established by hiQ Labs, Inc. v. LinkedIn Corp. (9th Cir., 2022) and similar authorities in the EU and UK regarding access to publicly available information. However, legality is jurisdiction-dependent and context-specific.

3.2 Your responsibility: You, not PiTech Studio, are solely responsible for ensuring that your use of competitor analysis features complies with:

• The target website's Terms of Service and robots.txt directives
• Nepal's Electronic Transactions Act 2063 (Section on unauthorised access)
• The Computer Fraud and Abuse Act (CFAA) — USA
• The Computer Misuse Act 1990 — UK
• EU Directive 2013/40/EU
• Database rights under EU Directive 96/9/EC
• Any applicable data protection laws if personal data is incidentally collected
• Local laws of the jurisdiction where the target website is operated

3.3 No authorisation implied: The availability of a competitor analysis feature does not constitute legal advice or an assurance that any specific audit is lawful in your jurisdiction. If in doubt, consult a qualified legal professional.

3.4 Data accuracy: Competitor analysis data reflects the state of publicly visible web pages at the time of the audit. It may be incomplete, outdated, or affected by caching, geographic targeting, or personalisation. We make no warranty as to the accuracy of competitor intelligence data.

3.5 PiTech Studio does not endorse using competitor insights to copy, plagiarise, or misappropriate a competitor's intellectual property or trade secrets.

SEO Agent integrates with external data sources and APIs. The following data in your audit reports comes from third parties over which we have no control:

• Core Web Vitals / PageSpeed scores: Google PageSpeed Insights API — data may lag real-world performance and is subject to Google's measurement methodology
• Domain Authority / Open PageRank scores: Open PageRank API — scores are third-party estimates, not official Google PageRank data
• AI citation tests (Perplexity / AI search results): Reflect real-time third-party AI search engine responses and are subject to change
• Google Search Console data: Where GSC integration is used, data is sourced directly from your GSC account via Google's official API
• Sitemap and robots.txt data: Fetched directly from the target domain; accuracy depends on the target server's response

PiTech Studio is not responsible for errors, delays, or discontinuation of third-party data sources. We do not represent that third-party data is accurate, complete, or current.

The Service and all outputs from SEO Agent are provided for informational and educational purposes only. Nothing produced by SEO Agent constitutes:

• Professional SEO consulting advice
• Legal advice (including on intellectual property, data protection, or competition law)
• Financial, investment, or business advice
• Accounting or tax advice
• Technical security advice

For decisions with significant financial, legal, or reputational consequences, we strongly recommend consulting qualified professionals in the relevant field.

6.1 The Content Optimizer add-on allows AI-generated content to be pushed directly to your CMS (WordPress, WooCommerce, Shopify, or custom API).

6.2 Review before publishing: AI-generated content pushed to your CMS may contain errors, inaccuracies, tone mismatches, or content inappropriate for your audience. You must review all AI-generated content before it is published publicly.

6.3 CMS modifications are your responsibility: Any changes made to your website through the Content Optimizer are your sole responsibility. PiTech Studio is not liable for content published to your website.

6.4 Backup recommendation: We strongly recommend taking a full backup of your website before using the Content Optimizer's bulk push features.

6.5 WooCommerce product descriptions: AI-generated product descriptions must be reviewed for accuracy, compliance with consumer protection laws (including Nepal's Consumer Protection Act 2075 and equivalent laws in other jurisdictions), and your product-specific legal requirements (e.g., ingredient accuracy, safety warnings, regulatory compliance).

7.1 SEO Agent produces audit scores (0–100) and grades (A+ to F) using PiTech Studio's proprietary scoring algorithm. These scores:

• Are not official assessments by any search engine or standards body
• May differ from scores produced by other SEO tools due to different methodologies
• Are subject to change as our methodology evolves
• May not fully reflect all factors that influence a page's actual search performance

7.2 Score comparisons between different audit dates are meaningful only when the same version of our scoring methodology is used for both audits.

7.3 A high score does not guarantee strong search rankings. A low score does not mean the page is penalised by any search engine.

SEO Agent audits technical SEO signals but is not a cybersecurity tool. The Service does not:

• Test for security vulnerabilities, malware, or data breaches
• Check for SQL injection, XSS, or other security flaws
• Guarantee that an audited website is safe, secure, or free of malicious content

For security assessments, engage a qualified cybersecurity professional or use dedicated security auditing tools.

9.1 HTML and PDF audit reports are stored on our servers and accessible via unique URLs. Report availability is subject to our data retention policy (90 days for most plans).

9.2 Reports are not encrypted at rest (they contain publicly audited URL data and SEO recommendations, not personal data). Do not include personally sensitive information in audit notes.

9.3 We do not guarantee indefinite availability of stored reports. Download and save important reports locally.

9.4 Lead report emails sent to unregistered users are not guaranteed to be delivered due to spam filters, email server configurations, or other factors outside our control.

10.1 We target high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

• Planned maintenance (communicated in advance where possible)
• Unplanned infrastructure failures
• Third-party API outages (Google PageSpeed, Anthropic, etc.)
• Events beyond our reasonable control (force majeure)

10.2 Audit processing depends on the availability and responsiveness of the target website being audited. We cannot guarantee successful audits of all websites.

11.1 PiTech Studio is a Nepal-based technology company. Use of the Service in Nepal is subject to all applicable Nepali laws, including but not limited to:

• Electronic Transactions Act, 2063 (2007) — including provisions on electronic contracts, digital signatures, and computer offences
• Individual Privacy Act, 2075 (2018) — data protection and privacy
• Consumer Protection Act, 2075 (2018) — consumer rights in digital services
• Telecommunications Act, 2053 (1997) and Telecommunications Regulation, 2054
• Nepal Rastra Bank directives applicable to digital payments
• Copyright Act, 2059 (2002) — intellectual property
• Company Act, 2063 (2006) — corporate compliance

11.2 AI-generated content is a rapidly evolving area of law in Nepal. Users should be aware that Nepal does not currently have specific legislation governing AI-generated content ownership. Legal status may change as Nepal develops its digital regulatory framework.

11.3 Users conducting competitor analysis against websites operated in Nepal should be aware of Section 47 of the Electronic Transactions Act 2063 (unauthorised access to computer systems) and ensure their use does not constitute a violation.
